Crohn’s Disease and Long-Term Disability

If you suffer from Crohn’s disease, you have likely found that many areas of your life have been impacted substantially. Living with a disease that impacts your digestive system and causes gastrointestinal distress can no doubt make even the smallest daily tasks seem unbearable and exhausting.   Any type of disease that impacts the body’s digestive system and interrupts the body’s natural balance and lead to severe consequences. As Hamilton long-term disability lawyers  we understand that for some, Crohn’s disease is manageable, but for others, who suffer from severe symptoms, Crohn’s can have a potentially devastating impact upon employment and the unpredictable fluctuating nature of it’s symptoms can severely disrupt working life.

What is Crohn’s Disease?

Crоhn’ѕ dіѕеаѕе іѕ an incurable tуре оf іnflаmmаtоrу bowel dіѕеаѕе (IBD). Symptoms and prognosis vary considerably amongst affected individuals. Crohn’s саuѕеѕ іnflаmmаtіоn оf your digestive tract, whісh саn lead to аbdоmіnаl раіn, ѕеvеrе dіаrrhеа, fаtіguе, wеіght loss аnd mаlnutrіtіоn. Whіlе there’s no knоwn cure fоr Crohn’s disease, therapies саn greatly reduce its ѕіgnѕ аnd symptoms аnd even brіng about lоng-tеrm rеmіѕѕіоn аnd healing оf іnflаmmаtіоn. With treatment, mаnу people wіth Crоhn’ѕ disease аrе аblе tо funсtіоn well – but unfortunately, many cannot.

Crohn’s disease impacts more Canadians than one may realize. According to the Canadian Digestive Health Foundation, Canada has one of the highest prevalence rates of Crohn’s disease and IBD in the world, and Public Health Canada estimates that more than 260,000 Canadians currently suffer from the disease.

Treatment options may require long periods of time away from work or home. Further, since there is no cure, treatments are symptom-oriented and therefore require long-term therapies and medical remedies. In other words, patients with Crohn’s disease may be forced to undergo treatment for the duration of their lifetime unless they go into remission.

Individuals who suffer from Crohn’s disease often suffer from severe pain and long-term complications. Inflammation of the digestive system can cause damage to the inside of the body and impact an individual’s ability to absorb nutrients.

What is the difference between between Crohn’s Disease, Ulcerative Colitis and IBS?

Crohn’s disease is a form of IBD that can affect any part of the GI tract (mouth to anus), although the end of the small intestine (ileum) and the beginning of the colon are most often affected. Ulcerative colitis only affects the large intestine (colon). Irritable Bowel Syndrome (IBS) is not a form of IBD. IBS is not an autoimmune disease and does not cause chronic inflammation that leads to intestinal damage. However, IBS is still a health condition and should not be ignored. Diet and lifestyle factors should be addressed to improve health with IBS.

Crohn’s Disease and Long Term Disability Benefits

Many symptoms and complications which arise from Crohn’s disease can impact an individual’s ability to work or perform the duties of their occupation.  Individuals who experience severe symptoms of Crohn’s may have difficulty performing the essential duties of their job.

Severe symptoms such as fatigue, abdominal pain, inflammation or chronic diarrhea can significantly impact the day to day activities of Crohn’s sufferers, as well their ability to work. If therapies and medications cannot keep the symptoms under control, a person’s ability to go out in public and handle daily activities may be severely limited let alone their ability to work. In some cases, the smallest workplace tasks or duties may become difficult or dangerous when any of the above listed symptoms are present. For example, someone suffering from fatigue may be a safety risk when working in a position that relies on physical labour, or an individual who has excessive diarrhea may be unable to work at a job site that does not have access to facilities.

In order to qualify for long-term disability benefits, you must be considered totally disabled, meaning that you are unable to work your own occupation. After two years, most disability insurance policies undergo a change of definition, wherein you must be able to prove that you are too disabled to work at any occupation for which you are suited by way of education, training or experience.

It is normally at the two-year mark, or at the “change of definition” that long-term disability adjusters seem to believe that claimants can automatically go back to work and do “something”. Insurance claims adjusters tend to rely heavily on the change of definition in order to wrongfully cut-off the claimant’s benefits. The problem is, insurance adjusters are often not aware of the complexities regarding disability law – nor are they aware of the severe financial implications experienced by claimants after the sudden termination of their long-term disability benefits.

It is not uncommon to see Crohn’s sufferers wrongfully denied or wrongfully cut off their long-term disability benefit – and if you are a loved one has been wrongfully denied or cut off your long-term disability benefits it’s important that you contact a long-term disability lawyer to help get your monthly disability payments back on track.

The human body is an intelligent organism. Everything it does is to protect itself and stay alive. When a substance enters the body that is not supposed to be there, the body knows and reacts. This is the immune system at work. Once the body detects an invader (called an antigen), antibodies are produced to destroy the invader whenever the immune system detects it.

In autoimmune disease, (auto-, meaning ‘self’ and immune, referring to the immune system) the immune system becomes chronically overactive and mistakes its own cells for those invading antigens. Over time, the damage from the immune system repeatedly attacking itself develops into a disease.

There is no known ultimate cause of autoimmune disease, and I do not believe there is one root cause, but several. Genetics contribute about 1/3 of a person’s chance for developing autoimmune disease, according to Dr. Sarah Ballantyne. 1 Throughout this book I will be discussing factors outside of genetics that can be addressed, therefore decreasing the risk for autoimmune disease or improving symptoms of an established disease.
