Under Ontario law, lawyers are permitted to pay a referral fee to another lawyer who refers a client for representation. As experienced personal injury specialists, Lalande Personal Injury Lawyers receives many of the firm’s personal injury, denied disability, and wrongful death cases as referrals from other practicing lawyers in Hamilton and throughout Ontario.
We have the experience, skills, track record, and connections to maximize case value. We are always happy to speak to you about your case, and we pay maximum referral fees permitted by the Law Society Rules of Professional Conduct.
Lalande Personal Injury Lawyers considers a client referral one of the highest compliments one lawyer can pay to another. We welcome the opportunity to co-counsel, joint venture, or assume the representation of clients. Our role may be extensive or limited, depending on the case and what you would like us to do.
Lawyers who practice in other areas of law might know and understand that litigating a catastrophic injury or wrongful death case can be quite difficult and expensive. Our firm can fund the high costs associated with litigating large and complex cases.
By referring your complex or serious Hamilton injury cases to our firm, you can conserve your office’s resources and concentrate on your firm’s area of practice. You can trust that Lalande Personal Injury Lawyers will fight to obtain the maximum possible recovery for clients you refer and provide the maximum referral fee the Law Society will permit.
First, we accept matters at all stages of litigation. Whether you are starting out a claim, in discovery, or approaching mediation or trial, we are happy to discuss your case with you. We promptly consider each potential Hamilton personal injury case referral on a case-by-case basis. We will get back to you without delay.
Second, we are happy to discuss referrals from lawyers concerning serious personal injury, catastrophic injury, wrongful death, denied long-term disability, and wrongful death cases.
The Law Society of Upper Canada imposes certain rules and regulations on to whom and how much a referral fee can be paid. A referral fee can only be paid by a lawyer to a lawyer. Secondly, the lawyer or paralegal receiving the referral must have the expertise and ability to handle the matter.
A referral fee cannot exceed 15 percent of the fees paid to the lawyer who received the referral for the first $50,000 of such fees for the matter and 5 percent of any additional fees for the matter up to a maximum referral fee of $25,000—and this fee must not increase the total amount of fee payable by the client.
In addition, up-front referral fees are not permitted. A referral fee may only be paid after the lawyer who has received the referral has received payment of his or her fees. For more information, see Section 3.6 of the Law Society’s Rules of Professional Conduct.
Many lawyers give consideration (or dream daily) about transitioning away from their law practice. Retirement, family, a new career, or some other pursuit comes calling.
